Laws and Regulations Every CDL Driver in Tennessee Should Know
Tennessee sits at the crossroads of the South. It borders eight other states, and some of the country’s major highways go through it, carrying heavy commercial traffic.
Memphis, situated at the Southwest border, is home to the world’s largest air cargo facility and is one of the top logistics hubs in the US. From here, a can reach 35% of the US population in a single overnight drive – or 68% within just two days. Nashville supplies retail, healthcare, and consumer goods to the entire Southeast, while Chattanooga has become an important hub for motor vehicles and automotive parts.
There are around 150,000 CDL licence holders in Tennessee, and they are the ones that keep this supply chain moving.
Tennessee enforces federal DOT standards through the Department of Safety and Homeland Security. The state runs inspections on major freight corridors, like I-40, I-65, I-24, and I-75. The FMCSA sets minimum random testing rates of 50% for drugs and 10% for alcohol. Since selection is random, there’s even a chance that you can be selected more than once.
If you fail the DOT test, your violation is reported to the FMCSA Clearinghouse, and your CDL gets downgraded. This means you can’t perform any safety-sensitive work until you complete the full return-to-duty process.
Here are rules and regulations you need to know as a CDL driver in Tennessee:
Federal Laws and Regulations
The Motor Carrier Safety Improvement Act of 1999 created the FMCSA, which oversees safety compliance for CDL drivers and commercial motor carriers across the country. This law imposes penalties for serious offenses even when they occur in a personal vehicle.
Under Section 201(g), as a CDL holder, you can face disqualification for:
- Driving under the influence of alcohol or drugs
- Possessing or using illegal substances
- Refusing a required chemical test
- Committing any major offense that leads to license suspension or revocation
Penalties:
- First offense: one-year CDL disqualification
- Second offense: lifetime disqualification (reinstatement possible after 10 years in some cases)
- Felony drug offense in a CMV: permanent disqualification
- Human trafficking using a CMV: permanent disqualification, no reinstatement
Under 49 CFR Part 382, you must complete DOT testing in these situations:
- Pre-employment drug testing (§ 382.301)
- Randomly during employment (§ 382.305)
- Post-accident testing after certain qualifying crashes (§ 382.303)
- Reasonable suspicion testing (§ 382.307)
- During the return-to-duty and follow-up phases after a violation (§ 382.309 and § 382.311)”
Under the FMCSA’s 2021 final rule and 2023 guidance, if you fail or refuse a DOT drug or alcohol test, or receive a “prohibited” status in the FMCSA Drug and Alcohol Clearinghouse, you cannot operate a CMV. State Driver Licensing Agencies take your privileges until you complete the full SAP process. Your violation stays on record for five years or until you complete the SAP process, whichever comes later.
Under 49 CFR Part 382 § 382.705, employers, MROs, SAPs, and C/TPAs must report DOT drug or alcohol violations to the FMCSA Clearinghouse through Login.gov. Any FMCSA-regulated employer can query this record when you apply for a new safety-sensitive position.
Under 49 CFR Part 40 § 40.285, a SAP evaluation is required if you:
- Test positive on a DOT drug or alcohol test
- Record a BAC of 0.04% or higher while operating a commercial vehicle
- Refuse or fail to take a required test
- Submit a tampered or substituted sample
- Violate any other DOT drug or alcohol rule
Under 49 CFR Part 40 § 40.305, you can only return to duty once you:
- Pass a return-to-duty drug or alcohol test with a negative result
- Complete all SAP-required education or treatment
- Show a BAC below 0.02% for alcohol-related violations
Even after meeting every requirement, your employer still decides whether to reinstate you.
Tennessee State Laws and Regulations
Under Tennessee Code § 55-10-401(3), you commit a DUI operating a commercial vehicle with a BAC of 0.04% or higher. For non-commercial drivers, the limit is 0.08% under Tennessee Code § 55-10-401(2). Under Tennessee Code § 55-10-401(1), law enforcement can still charge you with a DUI below those thresholds if alcohol or drugs impair your ability to drive safely in any way.
Tennessee incorporates federal CDL disqualification rules under Table 1 to 49 CFR § 383.51 alongside Tennessee Code § 55-50-405. These rules apply whether the offense occurs in a commercial or personal vehicle.
Major offenses include:
- Driving under the influence of alcohol or drugs
- Operating a CMV with a BAC of 0.04% or higher
- Leaving the scene of an accident
- Using a CMV to commit a felony
- Refusing a required chemical test
Disqualification periods:
- First offense (non-hazardous): one-year CDL disqualification
- First offense with HAZMAT: three-year disqualification
- Second major offense: lifetime disqualification (reinstatement possible after 10 years for some offenses)
- Drug trafficking using a CMV: permanent lifetime disqualification, no reinstatement
Under Tennessee Code § 55-50-102(53) and § 55-50-405(5), serious traffic violations include:
- Speeding 15 mph or more over the limit
- Reckless driving
- Improper or erratic lane changes
- Following too closely
- Traffic violations resulting in death, injury, or property damage
- Operating a CMV without a CDL in possession
- Driving without the proper CDL class or endorsements
- Using a handheld phone or texting while driving
Disqualification periods:
- Two violations within three years: 60-day disqualification
- Three or more violations within three years: 120-day disqualification
Under Tennessee Code § 55-50-405(7), a conviction for operating a CMV after receiving an out-of-service order results in immediate CDL disqualification.
Penalties:
- First offense: 180-day suspension, plus a minimum $2,500 civil penalty
- Second offense within 10 years: 2-year suspension, plus a minimum $5,000 civil penalty
- Third offense within 10 years: 3-year suspension
- Enhanced penalties apply if HAZMAT or passenger transport is involved
Tennessee incorporates federal crossing rules under 49 CFR § 383.51(d) via Tennessee Code § 55-50-412 and § 55-50-405(9).
Violations include:
- Failing to slow down or check for trains
- Failing to stop when required
- Crossing without enough space to clear the tracks
- Ignoring signals or enforcement at crossings
Disqualification periods:
- First offense: 60 days
- Second offense within three years: 120 days
- Third or subsequent offense within three years: at least one year

What Tennessee Drivers Say

FAQs
A DOT SAP evaluation is a required process for CDL drivers who violated federal drug or alcohol rules. You can’t return to any safety-sensitive job until you complete it.
During a DOT evaluation, a Substance Abuse Professional will:
- Go through your violation
- Review your history with alcohol and substance use
- Create a personalized plan
- Track your progress through the program
- Determine when you meet requirements to return to duty
Your personalized plan may include counseling, education programs, or treatment. It’s also followed by a return-to-duty test and follow-up testing. Only when you complete every requirement can you go back on the road.
Any DOT-regulated employee in Tennessee who fails or refuses drug or alcohol testing must complete the SAP process before returning to work.
This includes:
- CDL holders operating commercial motor vehicles
- HAZMAT drivers
- Bus operators transporting 16 or more passengers
- Full-time and part-time commercial drivers
- CDL holders working for government agencies
DOT testing requirements apply in all of these situations:
- Before starting a new driving job
- Through random selection during your employment
- After qualifying accidents
- When a supervisor has reasonable suspicion
If you fail or refuse any test, you get removed from duty immediately. Your violation goes into the FMCSA Drug and Alcohol Clearinghouse, and you need to start the return-to-duty process with a SAP evaluation.
According to our 2026 report, 43.4% of violations came from a random test, rather than from an accident or a reasonable suspicion test.
Every day off the road in Tennessee is money out of your pocket.
That’s why it’s important to find a DOT SAP provider who will schedule your evaluation fast and communicate clearly.
Look for a provider that:
- Books virtual same-day or next-day evaluations, so you can start right away
- Sends written updates to you and your employer after every step
- States full cost before you book, with payment plans available
- Holds credentials including CEAP, CADC, ICADC, IS, and DOT SAP
- Helps connect you with required education programs, counseling, or support groups
- Keeps your records for five years and provides support throughout the process
Getting you back on the road requires six steps:
- Contact Us — Book a same-day virtual appointment from your spot, wherever in Tennessee you might be. Memphis, Nashville, Knoxville, Chattanooga – no need for office visits.
- Initial SAP Evaluation — Graham sits down with you one-on-one for a full assessment. He reviews your situation and builds a clear plan.
- Follow Your Treatment Plan — Your SAP assigns you to the program, and you must complete every requirement before moving forward.
- Follow-Up SAP Evaluation — Once you finish, your SAP confirms you met the requirements, and you are ready for your return-to-duty test.
- SAP Report Sent to Your Employer — Your SAP sends the completed report directly to your employer, getting you back in line for your return-to-duty test.
- Follow-Up Testing Period — Federal law requires at least 6 unannounced tests in the first 12 months. Your SAP sets the exact number and schedule, which can run up to 5 years.
Most clients complete the full process in 1 to 2 weeks. We guide you through the SAP portion of the process, deal with required documentation, and coordinate with your employer at every step so you always know where you stand.
The cost depends on the provider you choose and your specific situation, including whether your SAP requires education or treatment on top of the evaluation.
At American River Wellness, the base fee is $450, and payment plans start at $112 through Klarna, Affirm, or Afterpay if approved. That fee covers your initial evaluation and follow-up assessment with no hidden charges.
If your SAP requires education, treatment, or a return-to-duty test, these are billed separately. We keep your records for five years and provide consultation support throughout that period, at no additional cost.
Most drivers don’t realize how much the total process can actually cost. Our 2026 report found that 61.3% of drivers paid more than $450 just for their evaluation, and 69.8% lost more than $3,000 in income while waiting to get back to work.
No SAP program is free. Who covers the cost depends on your employer’s policy, union agreement, or benefits package. In many cases, drivers pay out of pocket, but check with your employer or union first. Our price is below the national average, so the cost is not just another barrier between you and the road.
Pull together paperwork related to your DOT violation, review your employer’s drug and alcohol policy, and stay away from all substance use. Take time to go through the return-to-duty steps. The more prepared you are, the smoother the process will be.
The length of your DOT SAP program depends on your situation and how fast you move through each requirement.
Most drivers in Tennessee complete the full process, including evaluation and follow-up, within 3 to 7 days. That’s well ahead of the national average.
